TERMS FOR THE SUPPLY OF OUR SERVICES
This page (together with the documents referred to on it) tells you the terms on which we supply any of the services (Services) listed on our website www.spoonfultours.co.uk (our site) to you. Please read carefully and understand these terms before ordering any Services from our site. By ordering any of our Services, you agree to be bound by these terms.
Please click on the button in the order form, marked "I accept your terms" if you accept them. If you refuse to accept these terms, you will not be able to order any Services from our site. If you have difficulty in understanding any of these terms or have any other queries, please contact us at dasha@spoonfultours.co.uk. We will be happy to help.
You should print a copy of these terms for future reference.
Note that these terms do not apply at all if you are buying a product or a service from a third party seller via our site, even if we are accepting your order as agent for that seller. In such cases, the position will be made clear to you and you will be directed to the terms of that seller. Your contract will be with that seller; as a result, we can give no commitments of any nature about the products or services which you buy from that seller, whether as to quality, quantity, delivery or price.
INFORMATION
A description of the main characteristics of the Services is contained on our site. Such a description will be contained in the Order Confirmation mentioned on the pages entitled “Tours” and “Booking, Tickets and Payment”.
The price of Services and arrangements for payment are as described in the page entitled “Tours".
If you cancel the Services the consequences are set out below.
The technical means for concluding the contract to buy Services are set out in the section below entitled How the contract is formed between You and Us. If you make a mistake in inputting information, please click on the back arrow and you will be able to change it.
The language of the contract will be English.
YOUR STATUS
By placing an order through our site, you warrant that:
you are legally capable of entering into binding contracts;
you are at least 18 years old;
you are placing the order as a consumer: an individual acting outside his or her business; and
you are fit to travel and to undertake the tour, and will be at the time of the tour.
If we discover that any of these warranties is incorrect, we shall be entitled to terminate the contract between us and to pursue any legal remedies that we may have under the general law.
HOW THE CONTRACT IS FORMED BETWEEN YOU AND US
Your order for Services constitutes an offer to buy the Services and all orders are subject to acceptance by us. After placing an order, you will receive an e-mail from us acknowledging that we have received your order. Please note that this does not mean that your order has been accepted or that a contract has been made. We will confirm acceptance to you by sending you an e-mail that confirms that we have accepted your order (Order Confirmation). The contract between us (Contract) will only be formed when we send you the Order Confirmation.
The Contract will relate only to those Services that we confirm in the Order Confirmation.
AVAILABILITY
Your order will be fulfilled on the date set out in the Order Confirmation. If we cannot meet the date proposed by you, we will contact you and either agree a different date or permit you to cancel the Contract, in which case we will refund money paid in accordance with our refunds policy (set out in the following section).
PRICE AND PAYMENT
The price of any Services will be as quoted on our site at the time of your order, except in cases of obvious error. Prices are liable to change at any time, but changes will not affect orders in respect of which we have already sent you an Order Confirmation.
These prices include VAT.
We are under no obligation to provide Services to you at an incorrect lower price, even after we have sent you an Order Confirmation, if the pricing error is obvious and unmistakeable and could have reasonably been recognised by you as a mis-pricing.
Payment for all Services must be by Sterling cheque or bank transfer.
Payment Terms
In full on booking
Cancellation charges:
20% of the total tour value if cancelled more than 65 days prior to date of departure; or
100% of the total tour value if cancelled 0-64 days prior to date of departure.
Changes
Changes of date, occupancy, names, schedule (not including changes to itinerary) within the same travel season (September to August) subject to availability and at our sole discretion but may be possible if requested up to 65 days before the first scheduled service of the tour. No changes will be permitted within 65 days of the first scheduled service; any requests will be considered on a case-by-case basis. We shall notify you of any associated fees before we make any such changes.
Downgrade in occupancy after the deposit payment is collected (i.e. reducing the number of travelers) is considered a cancellation of the full tour and is subject to the cancellation penalties associated with your reservation.
PRICES, RATES & FARES
Unless otherwise indicated all prices and rates shown are in Sterling. We reserve the right to increase tour prices to cover increased costs of tariffs, taxes and fluctuations in foreign exchange markets.
TRAVEL DOCUMENTS
All passengers must be in possession of a valid passport and visa; its validity must be for six months beyond the re-entry date into the passenger’s home country. Please check your visa requirements at time of booking. It is the passenger’s responsibility to ensure that all his or her visa and passport requirements are met.
INSURANCE & LIABILITY
We strongly recommend purchasing travel insurance that protects you and your investment in the event of a sudden emergency before or during your trip and coverage for trip cancellation or interruption, illness, injury, and damage, loss or theft of baggage, as well as emergency assistance.
HEALTH REQUIREMENTS
We strongly recommend that you consult with your personal physician in regard to your itinerary and required inoculations. If you have any medical condition or allergy that may interfere with your trip, you are required to complete a “Medical Waiver” and your physician must certify that you are fit to travel. Failure to complete and return this waiver to us may result in cancellation of your tour without a refund.
WHAT YOUR TOUR PRICE INCLUDES
Accommodation
Accommodation, if specified in the itinerary, will be provided on a double-occupancy basis. Rooms will be assigned as available, in categories as specified in the itinerary. All per-person rates are based on double occupancy of the respective accommodation units as described above.
Sightseeing & Land Tour Services
The following services, if specified in the itinerary, are included in your tour price: transportation between the airports and hotels, sightseeing with English-speaking guides as mentioned in the itinerary. Sightseeing will be via motor coach, private car and other modes of transportation as outlined in the itinerary.
Classes
Cooking classes as specified in the itinerary.
Visas
Services in relation to securing an appropriate Russian visa.
Special Entertainment
Cultural entertainment events, gala evenings and festivals are not included unless specified in the itinerary.
Luggage
Luggage arrangements, if specified in the itinerary, include transportation and transfer of two standard sized suitcases per person. You should check any relevant airline restrictions.
Tour Price Exclusions
Your tour price does not include: air transportation (unless specifically stated as included); costs and fees to obtain or extend your passport; inoculations and vaccinations (if required); health certificate; airport taxes and country departure taxes (if applicable); all items of a personal nature including incidental beverages, meals not specified in the itinerary, any gratuities, excess baggage charges, cancellation, health, accident and baggage insurance, any transfers not specified in the itinerary, and any items not specifically listed as included.
PHOTOGRAPHY
We reserve the right to take photographs during the operation of any programme and to use the resulting photographs for promotion. Any tour passengers who prefer that their images are not used are asked to notify their tour escort at the beginning of the tour.
RESERVATION OF RIGHTS
We reserve the right to: (1) cancel any itinerary or any part of it; (2) make any alterations to the itinerary (including but not limited to alterations and substitution of hotels); and (3) decline to accept or to retain any person as a tour passenger should that person’s health, mental or physical condition in our sole opinion impede the operation of the tour of the other passengers. Tour passengers are held responsible for being in sufficient good health to undertake the tour. If a passenger is asked to leave while the tour is in progress, that person will be responsible for charges incurred on account of his or her departure from the tour and return to his or her home country. In such a case, we will not refund any money. We will accept no further liability or obligation toward that person or any third party.
LIABILITY DISCLAIMER
The information published on our site may include inaccuracies or typographical errors. Changes are periodically added to the information on it. We may make improvements or changes in our site at any time. We make no representations about the suitability of the information on our site for any purpose. We shall use reasonable care and skill in carrying out the Services. We disclaim all warranties, terms and conditions with regard to the information published on our site and the Services, including all implied warranties, terms and conditions, by statute, collaterally or otherwise, of satisfactory quality, fitness for a particular purpose, title, and non-infringement. In no event shall we be liable for any, indirect, incidental, special, or consequential damages arising out of or in any way connected with the use of our site or with the delay or inability to use our site, or for any information obtained through our site, or for the Services or otherwise arising out of the use of our site, whether based on contract, tort, strict liability or otherwise, even if we have been advised of the possibility of damages, except in relation to liability for death or personal injury, for which no limit applies. We shall be liable for direct loss arising out of the use of our site and in relation to the Services, whether based on contract, tort, strict liability or otherwise, up to a maximum of the total value of the transaction under which the claim arises for any one event or series of connected events. This does not affect your statutory rights as a consumer.
MODIFICATION OF THESE TERMS AND CONDITIONS
We reserve the right to change the terms, conditions, and notices under which the Services are offered. This right shall not affect the existing terms and conditions accepted by you on making a legitimate reservation or purchase using our site.
intellectual property
As between you and us, all intellectual property in the Services and how they are described that subsists now or at any time in the future shall without limitation vest in us and be our absolute property.
WRITTEN COMMUNICATIONS AND NOTICES
We will mainly communicate with each other electronically, such as by email. Applicable laws may require that some of the information or communications we send to you should be in writing, for which purpose we both agree that electronic communications will suffice. This paragraph does not affect your statutory rights.
All notices given by one of us to the other must be given in writing and delivered by hand, post, fax or email. Notices to us should be given in accordance with the details in paragraph 1. Notices to you may be given to the email address or the postal address provided when you placed your order.
TRANSFER OF RIGHTS AND OBLIGATIONS
Any contract by which we supply Services to you is personal and may not be assigned. We may however sub-contract some of the Services.
EVENTS OUTSIDE OUR CONTROL
Neither of us shall be liable to the other for any delay or non‑performance of our respective obligations under the Agreement to the extent that performance is interrupted or prevented by any act or omission beyond our reasonable control. This paragraph does not affect your statutory rights.
WAIVER
If either of us does not insist upon strict performance of any of the other’s obligations under the Contract or any of these terms, or if either of us does not exercise any of the rights or remedies to which we are entitled under the Contract, this shall not constitute a waiver of such rights or remedies and shall not relieve the other of us from compliance.
LAW AND JURISDICTION
Contracts for the purchase of Services through our site will be governed by English law. Any dispute arising from, or related to, such Contracts shall be subject to the non-exclusive jurisdiction of the courts of England and Wales.
